Terms & Conditions
fine art commissions
By commissioning artwork from Rebecca Jones, you agree to the following Terms & Conditions. Please read them carefully before making payment.
1. Commission Agreement
A commission is considered confirmed once the commission details have been agreed and the required booking fee or full payment has been received.
The commission brief should include the agreed subject, style, size/format, number of subjects or characters, background requirements, and any other relevant details. Changes to the brief after work has begun may result in additional charges.
2. Payment
A 50% non-refundable booking fee is required before work begins. The remaining balance is due upon approval of the final piece, before delivery.
For commissions below £100, full payment may be required upfront.
Work will not be delivered in its final form until the agreed balance has been paid in full.
Any additional work requested outside the original agreed brief may be charged separately.
3. Revisions
The commission includes two rounds of reasonable revisions at the agreed stage of the process.
Revisions should relate to the original commission brief. Significant changes to the composition, subject, concept, or brief after approval may incur an additional fee.
Once the final artwork has been approved, further changes may be charged at an hourly or agreed fixed rate.
4. Timescales
An estimated completion date will be provided when the commission is agreed.
Completion times may vary depending on the complexity of the artwork and the artist's existing workload. I will communicate any significant delays as soon as reasonably possible.
The client is responsible for providing references, information, approvals, and feedback promptly. Delays in receiving these may extend the completion date.
5. Cancellation
If the client cancels the commission after work has begun, the booking fee will remain non-refundable.
If a substantial amount of work has already been completed, the client may be responsible for payment for work completed up to the date of cancellation.
I reserve the right to cancel a commission in circumstances where it is no longer reasonably possible for me to complete the work (e.g. serious illness or injury, significant personal circumstances). In such circumstances, any payment relating to work that has not been completed will be refunded.
6. Refunds
Due to the personalised nature of commissioned artwork, refunds are generally not available once work has commenced.
If there is a significant issue with the completed artwork that is the result of an error on my part, I will make reasonable efforts to correct it where possible.
7. References and Client Materials
The client is responsible for ensuring that any photographs, artwork, logos, characters, or other reference materials supplied for the commission may legally be used for this purpose.
I am not responsible for copyright infringement arising from materials supplied by the client.
8. Copyright
Unless otherwise agreed in writing, copyright in the artwork remains with the artist.
Purchasing a commissioned artwork does not automatically transfer copyright to the client.
The artist retains the right to reproduce the artwork for purposes such as portfolio display, website and social media promotion, exhibitions, advertising, and other self-promotional purposes, unless the client and artist agree otherwise in writing.
Unless otherwise agreed in writing, no prints, reproductions, merchandise, or other commercial copies of a commissioned artwork will be produced or made available for sale by the artist.
9. Client Usage
Unless a commercial licence has been agreed, the client may use the commissioned artwork for personal, non-commercial purposes only.
The artwork may not be resold, reproduced commercially, licensed to third parties, used on merchandise, or otherwise exploited commercially without prior written permission.
Commercial usage and copyright transfers can be negotiated separately and may incur an additional fee.
10. AI and Alterations
The commissioned artwork may not be uploaded to generative AI services for the purpose of generating derivative works, training models, or substantially altering or reproducing the artwork without the artist's prior written permission.
Any significant alterations or derivative versions created by the client or a third party should be agreed with the artist in advance.
11. Delivery
Physical artwork will be delivered or shipped using the method agreed at the time of commission. Any postage, packaging, customs charges, or other delivery costs will be the responsibility of the client unless otherwise agreed.
The artist is not responsible for delays or damage caused by postal or courier services, although reasonable assistance will be provided in resolving delivery issues.
12. Original Physical Artwork
Where a physical original is commissioned, ownership of the physical artwork transfers to the client once full payment has been received.
Ownership of the physical artwork does not transfer copyright or reproduction rights unless expressly agreed in writing.
13. Portfolio and Social Media
Unless the client requests confidentiality before work begins, I may photograph, display, and share the commissioned artwork for portfolio, website, social media, promotional, and exhibition purposes.
Where appropriate, the client may be credited when the artwork is shared.
14. Communication and Approval
The client agrees to provide clear and timely feedback during the commission process.
Approval given by the client at a particular stage will be considered confirmation that the artwork may proceed to the next stage.
Failure to respond within 14 days of a request for feedback may result in the commission being paused or rescheduled.
15. Unforeseen Circumstances
I will not be liable for delays caused by circumstances reasonably outside my control, including illness, emergencies, technical failures, loss of equipment, or other unforeseen events.
I will communicate with the client and make reasonable efforts to complete the commission as soon as possible.
16. Acceptance
By making payment for a commission, the client confirms that they have read, understood, and agreed to these Terms & Conditions.
These Terms & Conditions may be updated from time to time. The version applicable to a commission will be the version agreed at the time the commission is confirmed.
